WASHINGTON, D.C. – Today, the top Republican on the House Ways and Means Committee Rep. Kevin Brady (R-TX) released the following statement following the U.S. Supreme Court decision on California v. Texas, which challenged the constitutionality of the Affordable Care Act (ACA).

“I’m disappointed. Justice Alito is right: three times the Supreme Court has stepped in to improbably save the Democrats’ flawed health care law, written behind closed doors and stuffed with special interest giveaways that drove up health care costs for millions of working Americans.

 

“Millions of lower income Americans and the states they live in were hurt by Obamacare’s coercive individual mandate tax penalty, and Republicans acted to zero out the mandate when the Supreme Court wouldn’t.

 

“I’m confident we will continue to protect all Americans’ access to health care and fight against any and all of the Democrats’ middle-class taxing burdens.”

Rep. Brady’s home state of Texas led 17 other states, in challenging the constitutionality of the ACA’s individual mandate in December 2018.

A federal judge in Texas ruled Obamacare unconstitutional.

In December 2019, the Fifth Circuit Court of Appeals ruled the Affordable Care Act’s individual mandate unconstitutional.
